Terms of Service

1. Acceptance of these terms
By accessing or using Carousel-gen (the "Service") you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or 16 if you are in the EU/UK) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. The service
Carousel-gen helps you generate social-media carousels using third-party AI models. We may add, change, or remove features at any time. The Service is offered "as is" and we make no guarantees about uptime, output quality, or fitness for any particular use.
4. Accounts
- You are responsible for keeping your credentials secure and for all activity that occurs under your account.
- Notify us immediately at hello@carousel-gen.com if you suspect unauthorized access.
- One account per individual. You may not share, sell, or transfer your account.
5. Acceptable use
You agree NOT to use the Service to:
- Generate, store, or distribute content that is illegal, infringing, defamatory, harassing, hateful, sexually explicit involving minors, or otherwise harmful.
- Impersonate any person or entity or misrepresent your affiliation.
- Attempt to upload, transmit, or generate malware, viruses, or other malicious code.
- Scrape, mirror, or systematically harvest the Service or its outputs except via documented APIs.
- Spam, mass-message, or otherwise abuse third parties using outputs from the Service.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use outputs to create or spread disinformation, deepfakes of real people without consent, election interference content, or content that violates the policies of TikTok, Instagram, or other platforms you publish to.
- Circumvent rate limits, credit deductions, billing, or any other access controls.
- Use the Service to train competing AI models.
We may suspend or terminate accounts that violate these rules without prior notice.
6. Credits and billing
- The Service runs on a prepaid credit model. Credits are purchased through Stripe.
- One image generation costs one credit, deducted at the time of generation.
- If a slide fails after our retry attempts, the credit for that slide is automatically refunded to your balance.
- Credits successfully consumed are non-refundable.
- Purchased credits do not expire while your account remains active.
- Pricing and credit pack sizes may change. Existing balances are honored at the value at which they were purchased.
- You authorize Stripe to charge your selected payment method for each purchase.
7. Refunds
Generated outputs are non-refundable once delivered. If you have purchased credits and have not yet consumed them, you may request a refund within 14 days of purchase by emailing hello@carousel-gen.com. Technical issues that prevent normal use are reviewed case-by-case at our discretion.
8. Your content
You retain ownership of the prompts you submit and the outputs generated for you, subject to the terms of the underlying AI model providers and applicable law. You grant Carousel-gen a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your content solely as needed to operate the Service for you.
You represent and warrant that you have all necessary rights to submit your inputs and to use the resulting outputs.
9. Our intellectual property
The Service, including the software, design, branding, copy, and trademarks, is owned by Carousel-gen and protected by intellectual property laws. Nothing in these Terms transfers any ownership of our property to you.
10. Third-party services
The Service depends on third-party providers (including Anthropic, OpenAI, Stability AI, Replicate, Stripe, Supabase, Cloudflare, Railway, and Google). Your use of the Service is also subject to the terms and policies of those providers where applicable. We are not responsible for outages, data handling, or content decisions made by those providers.
11. AI-generated content disclaimer
Outputs from AI models can be inaccurate, biased, offensive, or may inadvertently resemble third-party works. You are solely responsible for reviewing outputs before publishing them and for ensuring they comply with the rules of any platform on which you post them. We make no warranty that outputs are accurate, original, or suitable for any particular purpose.
12. Termination
You may stop using the Service or close your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraud or abuse, or fail to pay amounts due. On termination, the licenses you grant us continue only to the extent necessary to comply with law, resolve disputes, or wind down the Service.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT OUTPUTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAROUSEL-GEN AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent your jurisdiction does not, the above limits apply only to the maximum extent permitted.
15. Indemnification
You will indemnify, defend, and hold harmless Carousel-gen and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your content, (b) your use of outputs from the Service, (c) your breach of these Terms, or (d) your violation of any law or third-party right.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.
At our or your option, disputes may instead be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Each party waives any right to a jury trial and to participate in a class action.
(Confirm and replace the governing-law jurisdiction with the actual state of incorporation of your operating entity before going live.)
17. Changes to these terms
We may update these Terms from time to time. Material changes will be posted on this page and, where appropriate, communicated via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
18. Severability and entire agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Carousel-gen regarding the Service.
